Official conditions of the campaign WMF VIP Club

SECTION 1. CAMPAIGN ORGANIZER

1.1 The organizer of the "WMF VIP Club" Campaign (hereinafter referred to as the "Campaign") is WMF BULGARIA EOOD (the "Organizer"), a commercial company from Bulgaria, with headquarters in Sofia, 1504, Sredets district, 36, Shipka Street, registered in the Commercial Register of Republic of Bulgaria under UIC 201215755, legally represented by the manager Mr. Ivailo Grozdanov.

1.2 The campaign takes place with the support of the agencies (i) NEBE STUDIO LTD., with headquarters in Sofia, Bulgaria, Malina 5, Vitosha distr., registered in the Commercial Register of Republic of Bulgaria under UIC 204182901, legally represented by the manager Mr. Lubomir Kazasov (hereinafter referred to as "Nebe Studio") and (ii) STENIK GROUP OOD, with headquarters in Sofia, Bulgaria, 50 Gotse Delchev Blvd., fl. 1, office 1, Krasno selo distr., registered in the Commercial Register of Republic of Bulgaria under UIC 175129088, legally represented by the manager Mr. Stefan Chorbanov (hereinafter referred to as "Stenik Group")

1.3 The campaign will take place according to the provisions of these Official Terms of Use (hereinafter referred to as the "Terms of Use"), which are mandatory for all participants.

1.4 The Organizer reserves the right to modify the Terms of Use during the Campaign, but not before notifying the public at least 24 hours before the entry into force of the respective modifications on www.wmf.bg website.

 

SECTION 2. PLACE, CONTENT AND AVAILABILITY OF THE CAMPAIGN

2.1 The “WMF VIP Club” campaign will be organized and run exclusively on the web platform www.wmf.bg and in WMF physical stores located on the territory of Republic of Bulgaria, in compliance with the conditions and provisions of this Terms of Use.

2.2 WMF VIP Club is a free offer from WMF BULGARIA EOOD. As a member of WMF VIP Club, the Participants enjoy different benefits depending on the status of their membership.

2.3 Since WMF VIP Club is a free service, there is no right to uninterrupted use. There is no guarantee that access or use of WMF VIP Club will not be interrupted or impaired by maintenance work, further developments, or other disruptions, which may also lead to data loss. WMF BULGARIA EOOD strives to ensure that the WMF VIP Club services can be used as uninterrupted as possible.

2.4 WMF BULGARIA EOOD reserves the right to supplement the services offered as part of WMF VIP Club or to limit the use of the services provided. As a Participant, you are not entitled to retain certain proportionate services. However, WMF BULGARIA EOOD will always take your legitimate interests into account.

 

SECTION 3. PARTICIPATION, CONCLUSION OF CONTRACT

3.1 To participate to WMF VIP Club Campaign, the Participants must register accordingly. Registration could take place online, using our registration form on www.wmf.bg or during checkout in our online shop. Participants could also register in one of our WMF physical stores located on the territory of Republic of Bulgaria via the customer terminal.

3.2 The registration for the services of the WMF VIP Club is open only to natural persons who are not acting within the scope of his/her commercial or professional activity when registering (consumer within the meaning of § 13, item 1 of the Supplementary provision to the Bulgarian Consumer Protection Act) and only if the Participant is of legal age.

3.3 During the registration process the Participant will be asked to specify their access data and obligatorily to read and check the information related to the terms and conditions, as follows:

  • By registering in the campaign, I declare that I have read and agree to the Official Rules of the campaign, the Data Privacy Policy, the Terms and Conditions of www.wmf.bg.
  • I confirm that I meet the minimum legal age for participation (18 years old).
  • I declare that I agree with the processing of personal data in order to participate in the "WMF VIP Club" campaign organized by WMF BULGARIA EOOD. I declare that I agree with the processing of my personal data in order to validate any winnings and I agree to be contacted by e-mail or via telephone by the operator or person, authorized by the operator in this regard.

3.4 The access data consist of first and last name, valid email address and a freely chosen password. The Participants are obliged to provide complete and correct information when registering. If this data changes during the course of the Participants usage relationship, they are obliged to immediately correct their data in their personal settings. To change e-mail address and the date of birth, the Participants have to send a request to Organizer, using the contact form on www.wmf.bg.

3.5 By submitting their registration data, the Participants are making WMF BULGARIA EOOD a valid offer to conclude a membership (contractual relationship) based on these terms of use. WMF BULGARIA EOOD is free to decide whether to accept this offer at its own discretion.

3.6 With or without receipt of the email confirmation, membership is established on the basis of these terms of use and WMF BULGARIA EOOD activates the requested access. Once activated, the Participants are entitled to use WMF VIP Club.

3.7 The Participant is not permitted to take out multiple WMF VIP Club memberships at the same time.

3.8 The Participant's member account information can be edited and supplemented at any time via the customer account or by request through the contact form. Access the customer account takes place online using the access data selected by the Participant during registration. Membership and access data are not transferable. The access data must be kept secret and may not be passed on to third parties.

 

SECTION 4. WMF VIP CLUB ADVANTAGES

4.1. As a member of WMF VIP Club, the Participant is entitled to participate in the WMF VIP Club customer program. After registration, the Participant will become Silver member of the WMF VIP Club and an unique membership number will be automatically issued. Each time the VIP member is buying a product from the WMF physical stores, using the membership number, or from online shop, logged-in in their account, the value of the invoice will be cumulated in their member account. The cumulated value, shown in the progress bar visible in VIP account, will be updated each 24 hours, based on the chronology of transactions, with the values of purchases and values of returns or cancelations done by Participant in 365 days period. In case of online purchases, the value of transaction will be visible only after the invoice is issued and in case of returns, the value will be visible only after the credit note is issued.

4.2. As a Silver member, the participant will receive the following benefits:

  • Welcome bonus of 10% discount for the next purchase (voucher as specified during registration), which can be redeemed exclusively in the online shop, only if the member will subscribe for the first time to WMF newsletter, during or after registration. The welcome bonus can be applied only if the order value is minimum of 100 leva.
  • Annual birthday gift that can be redeemed exclusively in the WMF physical stores located on the territory of Republic of Bulgaria, only if the date of birth was specified by the Participant with minimum 5 days in advance and only in connection with an active subscription to WMF newsletter.
    In order to receive the gift, the customer is obliged to identify with an identity document proving that he/she really has a birthday in the period of claim, and he/she is the person with WMF VIP Club membership registration.
    The gift is determined at WMF's discretion. The gift may be different from one month to the other, without the need to notify the Customer.
    The time limit for claiming the gift in one of the WMF physical shops is maximum 14 days after the Customer's birthday. After this date, the right to receive the gift is no longer valid.
  • Periodically, exclusive offers and discounts, only in connection with an active subscription to WMF newsletter.
  • Easily manage the customer data and monitor your receipts, orders and returns.

4.3. Once one Participant reach the limit of purchases in a total amount of 1000 leva (VAT included), into their member account within a membership year, the Participant automatically achieves Gold member status, which is always valid for 365 days. The decisive factor for calculating the membership year is the period from the start of the membership. Once the Participant has achieved Gold status, it will apply from that point onwards and will end at the end of 365 days. From the moment the Participant achieves Gold member status, the period for reaching the balance of 1000 leva (VAT included) begins again for the following 365 days. The start and duration of the Participant Gold status will be displayed within their member account.

4.4. In order to book purchases into their member account, the Participants must be logged into his/her WMF VIP Club account when making purchases via online shop www.wmf.bg. When purchasing through our WMF physical stores, the Participant must provide the existing member account when making a purchase (e.g. via unique membership number or personal barcode provided after registration and available into WMF VIP Club account).

4.5. As a Gold member, the Participant will also receive the following premium benefits valid for one year:

  • Free shipping for purchases from the WMF online shop
  • 5% discount on every purchase in WMF physical stores located on the territory of Republic of Bulgaria and on the online shop www.wmf.bg.

In order to benefit of VIP Gold benefits, the Participant must be logged into his/her WMF VIP Club account when making purchases via online shop www.wmf.bg. When purchasing in WMF physical stores, the Participant must provide the existing member account when making a purchase (e.g. via unique membership number or personal bare code provided after registration and available into WMF VIP Club account).

4.6. All users that already have an active account on www.wmf.bg will become automatically members of WMF VIP Club. Based on the value of the purchases from the past 365 days before the start date of the campaign, the Participants will obtain Silver or Gold status.

 

SECTION 5. TERM AND TERMINATION

5.1. WMF VIP Club membership is for an indefinite period of time.

5.2. The Participants can cancel their membership at any time upon request, using the contact form.

5.3. WMF BULGARIA EOOD also reserves the right to terminate free access as a whole or to individual services with fourteen (14) calendar days' notice to the end of the month.

5.4. Both parties reserve the right to terminate the agreement for good cause, including breach of these Official Terms of Use.

5.5. If a Gold membership is canceled by WMF, the Gold member will retain the benefits in accordance with Section 4.5 until the regular end of the Gold membership. This does not apply to termination for good cause, as long as the member is responsible for the reason for termination.

5.6. After 3 years of inactivity after the date of registration, the account will be automatically closed at the end of the month.

5.7. In special legal cases (such as cases of fraud, misrepresentation, etc.), WMF BULGARIA EOOD reserves the right to immediately block the affected member account and the account from which the violation was committed.

 

SECTION 6. PERSONA DATA PROTECTION – GDPR

6.1. By participating in the WMF VIP Club campaign, you confirm knowledge of the provisions of the Official Terms of Use and express your consent regarding them and regarding the inclusion of personal data in the database of WMF BULGARIA EOOD.

The organizer, WMF BULGARIA EOOD, is the operator, according to the Regulation (EU) 2016/679 of the European parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, and Nebe Studio and Stenik Group are authorized by the Operator to process the personal data collected as part of this campaign for the purposes stated above. The purpose of this database is to offer consumer advantages and comply with the provisions of tax legislation. The organizer will keep the platform active for an indefinite period of time. The organizer undertakes that personal data will not be disseminated to third parties except for the companies involved in the organization and management of the campaign.

6.2. Participation in the Campaign is in no way conditional on the acceptance by the participants of receiving the newsletter from the Operator. Participants can at any time consent or withdraw their consent from receiving the newsletter.

6.3. During the Campaign, the Operator will process the following categories of personal data from the Participants:

  • (i) last name
  • (ii) first name
  • (iii) telephone number
  • (iv) email address
  • (v) date of birth
  • (vii) the data resulting from visiting the Campaign website;

6.4. The purpose of this personal data processing is to organize and run this campaign and comply with the obligations of the Operator. For people who accept receiving the newsletter, the purpose of the processing will also be the transmission of the newsletter.

6.5. The grounds for processing are:

  1. obligations deriving from the conduct of this campaign;
  2. the legitimate interest of the operator to ensure that the campaign is carried out in good conditions with regard to the data resulting from visiting the website;
  3. the legitimate interest of the operator to prove, including to the control authorities, the conduct of the campaign;
  4. the consent of the person concerned for the data processed in the case of persons subscribed to the newsletter.

6.6. The data of the members will be kept for the entire duration of the account within the platform, but no longer than 12 months from the moment the organizer decides to close the platform. The duration of the processing of the data of the persons subscribed to the newsletter is carried out until the withdrawal of the consent, to the extent that there is no other legal basis for the further processing of the data.

6.7. The Participants in the campaign are guaranteed the rights provided by the Regulation (EU) 2016/679 of the European parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, in particular the following rights:

  • The right to information according to which any data subject has the right to obtain from the operator upon request and free of charge the confirmation of the fact that the data concerning him is or is not processed by the Operator and the right of access to the data;
  • The right to rectification;
  • The right to erasure (“right to be forgotten”);
  • The right to restriction of processing;
  • The right to data portability
  • The right to object by which the data subject has the right to object at any time, for reasons related to the particular situation in which he is, to the data concerning him being the object of processing, unless the operator proves that he has reasons legitimate and imperative that justify the processing and that prevail over the interests, rights and freedoms of the data subject or that the purpose is to establish, exercise or defend a right in court.
  • The right not to be subject to a decision based exclusively on automatic processing, including profiling.
  • The right to withdraw consent

6.8. These rights can be exercised by sending a request using the contact form from the website www.wmf.bg

6.9. In this platform, participants have the opportunity to update personal data that is no longer current. These will automatically update in the database and affect all records in the campaign.

6.10. If the participants wish to stop the processing of their personal data before the date for which they provided their previous consent through this platform, a request to stop the processing and final deletion of the data can be sent. The request is sent using the contact form from the website www.wmf.bg. These requests will be resolved within one month. The Operator's Representative will send an e-mail notification to the participant when the request has been resolved.

6.11. Written requests will be sent to WMF BULGARIA EOOD, Sofia 1504, Sredets district, 36, Shipka Street and will be resolved by the Organizer, who is responsible for collecting the requests regarding the exercise of the rights guaranteed by Regulation (EU) 2016/679 from the participants in order to bring them to the attention of the Data Protection Officer (DPO). The organizer is also responsible for sending the responses to the participants who made such requests.

6.12. The organizer undertakes that personal data will not be disseminated to third parties, with the exception of agencies stated in Art. 1.2., and other companies involved in the organization and management of this campaign.

6.13. In addition, by participating in this campaign with the current regulation, you declare that you have read and acknowledged and agree to the Terms of Use, Terms and Conditions and Privacy Policy of WMF BULGARIA EOOD.

6.14. By participating in the current campaign, you agree to the processing of personal data for the purpose of this campaign, as mentioned above.

6.15. The Operator and the agencies stated in Art. 1.2. also undertake to comply with the provisions of the Regulation (EU) 2016/679 of the European parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

 

SECTION 7. LIABILITY

7.1. When using WMF VIP Club, WMF BULGARIA EOOD's liability for slightly negligent breaches of duty is excluded, unless damages resulting from injury to life, body or health or guarantees or claims under the Consumer Protection Act and Obligations and Contracts Act are affected.

7.2. Furthermore, liability for the violation of obligations, the fulfillment of which enables the proper implementation of the usage relationship and on whose compliance the Participant can regularly rely, remains unaffected.

7.3. The above liability rules also apply to breaches of duty by WMF BULGARIA ЕООD's legal representatives and vicarious agents.

 

SECTION 8. CHANGES TO THESE TERMS OF USE

8.1. WMF BULGARIA EOOD reserves the right to change these terms of use at any time with effect for the future. Such changes may in particular affect the type and scope of the members' benefits in accordance with Section 4. The Participants will be notified of any such changes at least 10 days before the changes are scheduled to take effect.

8.2. If The Participants do not object within 10 days of receipt of the notification and continue to use the services even after the objection period has expired, the changes will be deemed to be validly agreed upon expiry of the deadline. In the event of the Participant’s objection, the usage relationship will continue under the previous conditions. WMF BULGARIA EOOD reserves the right to terminate the usage relationship in accordance with Section 6 in the event of an objection. In the change notification the Participant will be informed of their right to object and the consequences.

 

SECTION 9. FINAL PROVISIONS, CONSUMER DISPUTE RESOLUTION

9.1. Bulgarian law applies, excluding Bulgarian international private law and the UN Convention on Contracts for the International Sale of Goods. As far as consumers are concerned, this choice of law clause does not affect consumer protection provisions that apply in the country in which the consumer has his or her habitual residence and which may not be deviated from by agreement under the law of that country.

9.2. Should a provision of these terms of use be or become invalid, the effectiveness of the remaining provisions remains unaffected. In such a case, the parties are obliged to cooperate in agreeing a regulation through which a result that comes as close as possible economically to the invalid provision is legally achieved. The above applies accordingly to the closing of any gaps in the contract.

9.3. WMF BULGARIA EOOD is neither willing nor obliged to take part in a dispute resolution procedure before a consumer arbitration board.
